1. Acceptance of Terms
By accessing or using NVH Lab (“the Application”), a product of ANEA LLC, you agree to be bound by these Terms of Service. If you do not agree, do not use the Application. We reserve the right to update these Terms at any time. Continued use after changes constitutes acceptance.
2. Eligibility
You must be at least 16 years of age to use the Application. By using NVH Lab, you represent that you meet this requirement.
3. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to provide accurate information and to update it as necessary. You may not share your account or use another user's account without permission.
4. Acceptable Use
You agree not to: (a) use the Application for any unlawful purpose; (b) upload content that is fraudulent, harassing, or violates third-party rights; (c) attempt to gain unauthorized access to our systems; (d) interfere with the Application's operation; (e) scrape or extract data beyond normal usage; (f) misrepresent calibration data to manipulate benchmarks. Users may report policy violations via the in-app reporting feature or by emailing contact [at] nvhlab.com. We reserve the right to remove content and suspend or terminate accounts that violate these terms. Repeat offenders will be permanently banned.
5. User-Generated Content & Public Contributions
You retain all rights to your acoustic data and recordings. Content you publish remains yours.
Public sharing is optional. Recordings are private by default, and private recordings remain private. Content becomes publicly visible only when you explicitly choose to publish it, for example to the Public Feed, a Club, or a public profile.
By publishing content, you grant NVH Lab a worldwide, non-exclusive, royalty-free license to host, display, distribute, and analyze the published content to provide the Application and generate community benchmarks. This license applies while the content remains published.
You may not publish content that is unlawful, abusive, harassing, threatening, defamatory, obscene, hateful, or fraudulent, or content that infringes third-party rights.
We may review, filter, hide, or remove published content that violates these Terms or our content policies. Content flagged by users or automated checks may be hidden from public surfaces while under review.
You can report content that concerns you and block other users using the in-app reporting and blocking tools.
Repeat offenders may have publishing restricted, or their accounts suspended or terminated.

6. Intellectual Property
NVH Lab, its logo, and all proprietary technology, algorithms, and design elements are the exclusive property of ANEA LLC. The Application is licensed, not sold. You may not copy, modify, distribute, sell, or lease any part of the Application.
7. Safety & Liability
NEVER operate this Application while driving. Use is intended for passengers or while the vehicle is safely parked. NVH Lab is not liable for accidents, injuries, or traffic violations resulting from use or misuse. Diagnostic data is for informational purposes only and does not replace professional mechanical inspection.
8. Limitation of Liability
To the fullest extent permitted by law, ANEA LLC and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Application. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
9. Indemnification
You agree to indemnify and hold ANEA LLC harmless from any claims, damages, or expenses arising from your use of the Application or violation of these Terms.
10. Termination
We may suspend or terminate your account at any time for violation of these Terms or for any conduct that we deem harmful to the community. You may delete your account at any time through Profile settings. Upon termination, your license to use the Application ends, but provisions regarding liability, indemnification, and data retention survive.
11. Dispute Resolution
These Terms are governed by the laws of France. Any disputes shall be resolved through binding arbitration in Paris, France, unless prohibited by applicable consumer protection laws. You agree to resolve disputes individually, not as part of a class action.
